Terms of Service

1. What BUSINA Is

BUSINA is a technology platform that provides information, visibility, discovery, tracking, and booking assistance for land transportation in the Philippines. It is a digital trip-planning and tracking tool — not a transportation service, not a ticketing system, and not a payment processor.

BUSINA is currently operating in pilot mode as an experimental technology platform for testing with selected partner operators. BUSINA is not yet a registered business entity. It operates in good faith under the laws of the Republic of the Philippines and intends to complete formal business registration as operations scale.

BUSINA is NOT a transport company. We do not own, operate, or manage any vehicles. We do not employ drivers. We do not sell bus or van tickets in our own name.

2. What BUSINA Does

BUSINA provides:

• Route discovery between transportation hubs
• Real-time GPS tracking of operator vehicles
• Estimated arrival times (ETAs)
• Seat booking assistance tools
• Communication between passengers and operators

3. Relationship Between Parties

When you book a trip through BUSINA, your agreement is with the OPERATOR, not BUSINA.

The operator is solely responsible for:

• Actual transport service and vehicle condition
• Fare pricing and fare accuracy
• Schedule accuracy and adherence
• Passenger safety
• Vehicle registration and insurance
• Driver licensing and employment
• Compliance with LTFRB, LTO, and other government regulations
• BIR registration and issuance of official receipts
• Compliance with local government requirements

4. Payments and Refunds

BUSINA does NOT process payments.

All payments are made directly to the operator via GCash, Maya, cash, or other methods as directed by the operator. BUSINA never collects, holds, or releases passenger fare payments.

Refunds and booking disputes are handled directly by the operator. If a trip is cancelled, delayed, or refunded, please contact the operator directly using the contact details provided with your booking. BUSINA does not issue refunds and is not responsible for the operator's refund decisions.

The ₱10 BUSINA Booking Fee covers platform services (tracking, notifications, booking tools). It is not a transport fare and is not collected by BUSINA in its own name in this pilot version of the platform.

5. Estimated Arrival Times (ETA)

GPS-based ETAs are estimates only. Actual arrival times may vary due to traffic, weather, mechanical issues, road conditions, and other factors beyond BUSINA's control. BUSINA is not liable for missed trips, delays, or any consequences arising from inaccurate ETAs.

6. User Conduct

Users agree NOT to:

• Provide false information during registration or booking
• Use BUSINA for illegal or fraudulent purposes
• Abuse, harass, or impersonate other users
• Attempt to hack, scrape, or reverse-engineer the platform
• Use automated tools to access BUSINA without permission

7. Operator Responsibilities

Operators using BUSINA agree to:

• Maintain valid LTFRB and LTO franchises and permits
• Keep all vehicle and driver information up to date
• Respond to bookings promptly
• Honor published fares and schedules
• Comply with all applicable Philippine laws
• Obtain all necessary BIR registrations and issue receipts
• Handle passenger disputes and refunds directly

8. Limitation of Liability

BUSINA is provided "as is" and "as available." We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of operator-provided information
• Availability of any specific trip
• Service quality of any operator

To the fullest extent permitted by law, BUSINA and its developer are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform, including but not limited to missed trips, delays, injury, loss of property, or financial loss.

9. Intellectual Property

All content, trademarks, logos, and software on BUSINA are owned by BUSINA and protected by Philippine intellectual property laws. Users may not use these without written permission.

10. Termination

BUSINA may suspend or terminate any user account for violation of these Terms. Operators may be deactivated if they fail to comply with platform policies or Philippine law.

11. Changes to Terms

BUSINA may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Disputes shall be resolved in the appropriate courts of the Philippines.
